DMCA & Copyright Takedown Policy

1. PURPOSE & LEGAL FRAMEWORK
This DMCA & Copyright Takedown Policy (“Policy”) sets out the procedure for submitting, reviewing, and acting upon copyright infringement notices relating to content available on RBN Broadcast platforms.
The Policy is framed to:
- Respect intellectual property rights
- Provide a clear notice-and-takedown mechanism
- Limit liability of the platform as an intermediary
- Comply with applicable Indian laws and internationally accepted copyright practices
This Policy operates in conjunction with the Copyright & Intellectual Property Policy and the Grievance Redressal Policy.
2. SCOPE OF APPLICATION
This Policy applies to all content hosted, streamed, or distributed on RBN Broadcast, including:
- News articles and editorial material
- Music, sound recordings, and compositions
- Audio-visual content and broadcasts
- Gurbani Kirtan and devotional recordings
- Metadata, thumbnails, and descriptive text
This Policy applies to rights holders, authorized agents, licensors, and any person claiming copyright infringement.
3. COPYRIGHT OWNERSHIP PRINCIPLE
Copyright subsists automatically in original works and does not require registration for protection.
RBN Broadcast respects copyright ownership and does not permit intentional infringement.
The platform acts as a facilitator/intermediary and does not assume ownership of third-party copyrighted material unless expressly stated.
4. DESIGNATED COPYRIGHT CONTACT
All copyright infringement notices, DMCA requests, and rights-related communications must be sent to:

Notices sent to any other address may not be processed.
5. SUBMISSION OF COPYRIGHT INFRINGEMENT NOTICE
A valid copyright infringement notice must be submitted in writing and include the following:
- (a) Identification of the copyrighted work claimed to have been infringed
- (b) Identification of the allegedly infringing content, including URL or platform reference
- (c) Name, address, email address, and contact details of the complainant
- (d) A statement of good-faith belief that the use is not authorized by the copyright owner, agent, or law
- (e) A declaration that the information provided is accurate and made under penalty of perjury
- (f) Proof of ownership or authorization to act on behalf of the copyright owner
Incomplete or unverifiable notices may be rejected without action.
6. REVIEW & VERIFICATION PROCESS
Upon receipt of a valid notice, the Legal & Compliance Department shall:
- Acknowledge receipt
- Conduct internal verification
- Assess ownership claims and licensing status
The platform may seek additional information where required.
The LLP reserves discretion to determine the validity of any notice.
7. TAKEDOWN, DISABLING & RESTRICTION
Where infringement is established or reasonably suspected, the LLP may:
- Remove the content
- Disable access to the content
- Restrict distribution or visibility
Takedown actions may be taken without prior notice to the uploader or contributor.
Removal does not constitute admission of liability or wrongdoing.
8. COUNTER-NOTICE PROCEDURE
Where applicable, a party whose content has been removed may submit a counter-notice including:
- Identification of the removed content
- Statement asserting lawful use or authorization
- Supporting legal or licensing documentation
- Contact details of the submitting party
Counter-notices shall be reviewed by the Legal & Compliance Department.
The LLP reserves the right to restore or permanently remove content based on legal assessment.
9. REPEAT INFRINGER POLICY
RBN Broadcast maintains a strict policy against repeat infringement.
Repeated or willful infringement may result in:
- Permanent removal of content
- Termination of access or contributor privileges
- Legal proceedings where warranted
Determination of repeat infringement rests solely with the LLP.
10. FALSE OR MALICIOUS CLAIMS
Submission of false, misleading, or malicious copyright claims is prohibited.
The LLP reserves the right to:
- Reject such claims
- Record misuse of the takedown process
- Initiate legal action where appropriate
11. NO MONITORING OBLIGATION
RBN Broadcast does not undertake proactive monitoring of all content for copyright infringement.
Action is taken upon receipt of valid notice or where infringement is otherwise brought to attention.
12. GOVERNMENT & COURT-ORDERED TAKEDOWNS
Content may be removed or blocked pursuant to:
- Court orders
- Government or statutory authority directions
Compliance may be effected without notice where legally required.
13. LIMITATION OF LIABILITY
The LLP shall not be liable for:
- Good-faith takedown actions
- Delays caused by incomplete notices
- Third-party disputes between rights holders and contributors
Liability, if any, is limited to the maximum extent permitted by law.
14. INDEMNITY
Complainants and contributors agree to indemnify and hold harmless the LLP from claims arising out of:
- Misrepresentation of ownership
- Unauthorized submissions
- Abuse of the takedown mechanism
15. POLICY UPDATES
This Policy may be amended to reflect changes in law or operational requirements.
Continued use of the platform constitutes acceptance of revised terms.
16. GOVERNING LAW & JURISDICTION
This Policy shall be governed by the laws of India.
Courts having jurisdiction over the registered office of Bani Global Industries LLP shall have exclusive jurisdiction.
17. LEGAL NOTICE
This DMCA & Copyright Takedown Policy is binding, enforceable, and intended to secure intermediary safe-harbor protections.
