Music & Audio Content Policy

Ruby Broadcast Network (RBN Broadcast)

(Issued by the Legal & Compliance Department of Bani Global Industries LLP)

1. PURPOSE & LEGAL INTENT

This Music & Audio Content Policy (“Policy”) governs the hosting, streaming, distribution, and legal use of all music, audio, sound recordings, podcasts, devotional audio, and allied content made available on RBN Broadcast platforms.

The Policy is designed to:

  • Protect intellectual property rights
  • Define the scope of user access
  • Mitigate copyright, royalty, and licensing risks
  • Ensure compliance with applicable laws and platform standards

2. OWNERSHIP & RIGHTS STRUCTURE

All music and audio content available on RBN Broadcast is either: (a) owned by Bani Global Industries LLP, or (b) licensed, assigned, or used under valid contractual arrangements with artists, labels, producers, or rights holders.

Music and audio content may involve multiple layers of rights, including but not limited to:

  • Sound recording rights
  • Musical composition rights
  • Lyrics and literary rights
  • Performer’s rights

No ownership or proprietary rights are transferred to users by access or streaming.

3. SCOPE OF AUDIO CONTENT

Audio content may include:

  • Songs and music tracks
  • Instrumental and background music
  • Gurbani Kirtan and devotional recitations
  • Podcasts, interviews, and discussions
  • News audio clips and narrations

Availability of content may vary by geography, time, or licensing restrictions.

4. USER LICENSE & PERMITTED USE

Users are granted a limited, non-exclusive, revocable, non-transferable license to stream audio content strictly for personal, non-commercial use.

The license expressly excludes the right to:

  • Download or permanently store audio
  • Reproduce or redistribute content
  • Synchronize audio with video, reels, films, or advertisements
  • Use content for public performance or commercial gain

Any use outside the permitted scope constitutes infringement and breach of contract.

5. PROHIBITED ACTIVITIES

Users shall not, without prior written authorization:

  • Copy, rip, record, or archive audio streams
  • Upload RBN audio content to third-party platforms
  • Use music or devotional audio in monetized videos, reels, shorts, or ads
  • Remix, edit, dub, sample, or alter audio content
  • Remove copyright notices, metadata, or credits

6. DEVOTIONAL & GURBANI AUDIO SPECIFIC TERMS

Gurbani Kirtan and religious audio content is published with reverence and cultural sensitivity.

Such content is provided for spiritual awareness and listening only.

Commercial exploitation, distortion, or remixing of devotional audio is strictly prohibited.

Religious nature does not constitute waiver of copyright or performer’s rights.

7. ARTIST, LABEL & RIGHTS HOLDER ASSURANCES

Artists, labels, or licensors providing content to RBN Broadcast represent and warrant that:

  • They hold valid rights to license the content
  • Content does not infringe third-party rights
  • All statutory royalties and permissions have been addressed

The LLP reserves the right to seek indemnification for misrepresentation.

8. COPYRIGHT CLAIMS & RIGHTS MANAGEMENT

Rights holders who believe their audio content has been used without authorization may submit a written complaint with:

  • Proof of ownership or authorization
  • Identification of the disputed content
  • Relevant URLs or references

Upon verification, the LLP may remove, disable, or restrict access to the content.

9. PLATFORM & DISTRIBUTION COMPLIANCE

Audio content may be distributed through third-party platforms or aggregators.

Such distribution is subject to the terms, policies, and technical standards of those platforms.

The LLP disclaims liability arising from actions taken by third-party platforms beyond its control.

10. MONETIZATION & COMMERCIAL USE

Unless expressly stated, audio content on RBN Broadcast is not licensed for commercial use.

Any commercial exploitation requires prior written agreement with the LLP.

Unauthorized monetization may result in legal action.

11. CONTENT MODIFICATION & WITHDRAWAL

The LLP reserves the right to:

  • Modify metadata or descriptions
  • Replace or update audio files
  • Withdraw content due to legal, licensing, or editorial reasons

Withdrawal does not imply admission of fault.

12. GOVERNMENT & REGULATORY ACTION

Audio content may be removed or blocked pursuant to lawful orders from courts or authorities.

Compliance may be effected without prior notice to users or contributors.

13. INDEMNITY

Users and content providers agree to indemnify and hold harmless the LLP from claims arising out of:

  • Unauthorized use of audio content
  • Rights infringement
  • Breach of representations

14. LIMITATION OF LIABILITY

The LLP shall not be liable for indirect, incidental, or consequential damages.

Liability, if any, is limited to the maximum extent permitted by law.

15. NO WAIVER & RESERVATION OF RIGHTS

Failure to enforce any provision does not constitute waiver.

All rights not expressly granted are reserved.

16. POLICY UPDATES

This Policy may be amended at any time without prior notice.

Continued access constitutes acceptance of revised terms.

17. GOVERNING LAW & JURISDICTION

This Policy shall be governed by the laws of India.

Courts having jurisdiction over the registered office of the LLP shall have exclusive jurisdiction.
